After you are arrested for a DWI in North Carolina, your driver's license will be revoked, typically for 30 days starting from the date of your arrest. If you are convicted of DWI, you will be subject to an additional period of revocation.
However, during the initial 30-day revocation you may eligible to receive a limited driving privilege, also known as an LDP.
Limited Driving Privilege
In North Carolina, having an LDP makes it possible for you to drive Monday through Friday between the hours of 6 AM and 8 PM so that you can attend work or school.
If your job or education requires that you drive outside of these days and/or hours, you can submit a letter from your place of education or employer to apply for an extension of your driving privileges.
Eligibility Requirements For Pre-Trial LDP
Not everyone who has been charged with or convicted of a DWI is eligible for LDP. In order to obtain limited driving privileges after serving 10 days of the initial 30-day suspension (or 30 days of a 45-day suspension):
- You must have had a valid drivers license at the time of your arrest
- You must not have any other suspensions at the time of your arrest
- You must not have any prior DWI convictions in the past seven years
- You must not have any pending DWI charges
- You must obtain a substance abuse assessment and register for recommended treatment
