Level II Punishment
North Carolina’s DWI sentencing structure is designed to impose certain penalties depending on the specifics of the case. A judge will assign a Level II punishment if there was no minor in the vehicle and only one grossly aggravating factor present.
Penalties for a Level II DWI include:
- One week to 12 months in jail
- A $2,000 fine
It is also possible to receive a Level II punishment if you have been convicted for a prior DWI within the past seven years.
Probation may be possible in some Level II cases, the terms of which include:
- Completion of a substance abuse assessment
- Completion of any recommended alcohol or substance abuse treatment program(s)
- Wearing a continuous alcohol monitoring (CAM) system for a period of 30 days to the end of your probation
